All Out Auction Terms & Conditions
All Equipment is located in Toronto, Ontario and can either be picked up at our facility or can be shipped (at an additional charge). Shipping can be arranged at buyer's expense direct to your location. Freight is billed based on weight and dimensions. Extra charges apply for skidding services, residential, tailgate, docking fees and beyond carriers. If you require shipping and/or skidding, please contact us at 1 416-708-3017.
TERMS AND CONDITIONS: - At the time of registration, we collect information about you to verify who you are before you can bid. We collect credit card information to ensure that you are a qualified buyer. A preauthorization of $500.00 shall be processed as part of the verification procedure. All bidders must be of legal age to bid. Bidders expressly authorize the Auctioneer to use their credit card to satisfy the payment amount as well any deposit required. When an auction closes, if you are the winner, you will be charged with the winning bid amount, plus applicable taxes( in Ontario-13%) and 18% Buyers Premium, unless relevant tax exemption documentation has been accepted by the auctioneer in advance. The total amount of the purchase price will be charged to your credit card at the close of the sale, if you are a winning bidder, unless other means of payment are prearranged with the Auctioneer, as set out below. Payment can be made by electronic transfer or cash if pre-arranged in advance. There is no cost to register for an auction. Your credit card will not be charged unless you win. By your registration you agree to accept all charges placed on the card that is used at registration and waive any and all rights concerning charge backs or refunds for any items charged off.
PAYMENT TERMS: - All payments are due upon the close of the Auction. Bidder hereby authorizes us to process the payment for all purchasers less than $10,000 using the credit card provided, unless Bidder has notified us by email prior to the close of auction, regarding an alternate payment method or the purchase is more than $10,000. In both instances, alternate forms of payment include wire transfer, pin-verified credit card or cash, or such other form that may be agreed upon by us in writing prior to Bidder’s participation in the auction. .Contact Chris Rodgers at Crodgers@gametimefun.com to arrange alternate payment method. Alternate payments shall be due and payable by close of business on the day following the close of the Sale. Auctioneer reserves the right to resell any property not paid for in full within 48 HOURS of the online auction item/lot's closing date. Items not paid in full within 48 hours will be considered abandoned and will not be released for pickup. No refunds or credits will be issued for any payments processed on merchandise that is abandoned. In the event Buyer fails to pay the entire purchase price by the payment deadline, the Auctioneer may retain and/or recover, upon demand, from Buyer the deposit and winning bid purchase price as liquidated damages for such failure. In addition, the auctioneer may, at its discretion, either resell Buyer's Items at a public or private sale without further notice to Buyer and/or dispose of the Items at Buyer’s sole expense. Any difference between the bid price for an item by the defaulting Buyer and the price received by the auctioneer at a resale shall be paid by the defaulting Buyer.
BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale.
WINNING NOTIFICATION & INVOICING: All winning bidders will receive an e-mail notification shortly after the auction’s closing. A successful bid at the auction constitutes acceptance of these Terms and Conditions of Sale and is a legally binding contract.
AS IS: -There are no warranties offered on any of the goods. The goods are sold "as is, where is". Games have been tested and are guaranteed functional at time of posting, unless stated otherwise. All known flaws are outlined in the item description. Functionality is described as operational. Items may or may not contain locks, keys and/or coin mechs. Some games have had coin doors altered to accommodate a card reader but have not been repaired after removal of the card reader. Bulbs, locks and keys, batteries and other minor cosmetic flaws do not fall under the category of functionality. There are no refunds, credit notes or exchanges of any kind on any goods or equipment.
CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE: - Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an 'as is, where is' basis, without guarantees of any kind, including counts. We strongly encourage all bidders to personally verify the condition of each item during the scheduled preview time (Tue., Dec.08) which is by appointment only, subject to all government Covid 19 restrictions. Masks, gloves and social distancing will be mandatory. Please call 1-888-273-2884 to schedule an appointment. More pictures can be provided if required. No responsibility is assumed by All Out Auction or the seller for any errors or omissions. If a description does not match a picture in a lot, the description takes precedence. All items are sold on an 'as is, where is' basis. By bidding you are acknowledging agreement with the terms above. You also acknowledge and approve all applicable charges to the credit card on file, registered at the time of bidding.
CLAIMS: - No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an 'as is, where is' basis.
PERSONAL & PROPERTY RISKS: - We will not be liable for damage or injury to individuals or their property.
ADDITIONS & DELETIONS: - We reserve the right to remove and/or add lots and/or items to the sale at any point up to or during the auction.
BUYERS: - The BUYER expressly agrees to indemnify and save All Out Auction, the Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of All Out Auction, or anyone acting in his/her behalf in connection with or arising out of auction, including, without limitation the removal of goods from the facility. All bidders/buyers must be of legal age. Auctioneer cannot and will not be held responsible for any interruption in service errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
AUCTION RECORDS: - In the event of a dispute, you agree to accept as true the information that we have in our records.
SOFT CLOSE: - Items close in 20 second intervals. All bids made in the last minute of the auction will cause an item to stay open for an additional 1 minute. This will continue until all bidding has ceased.
BIDDING: - We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.
REMOVAL: - Arrangements for the removal (or shipment) of the purchased items is the sole responsibility of the buyer. Removal shall be by curbside appointment ONLY from the Toronto facility. Please call 1-888-273-2884 to schedule an appointment. Buyer must pay in full before an appointment can be scheduled and before purchase will be released from the premises. Buyers without an appointment will be accommodated at Auctioneer’s sole discretion. Buyer is responsible to provide a printed copy of its paid invoice at time of pickup. Masks, gloves and social distancing will be mandatory.
Curbside only by appointment pick up times are as follows: Friday, December 11th – 12 noon – 5 pm; Saturday December 12th - 9 am - 4 pm, Monday December 14th - 9 am - 4 pm and Tuesday December 15th-9 am-4 pm Any curbside pickup outside of these times, must be confirmed by calling 1 888 273 2884.
Auctioneer may inspect to insure removal of proper items and lots. Buyers should bring their own moving equipment and labor, unless otherwise agreed in advance. Any item not removed or left on premises after Tuesday December 15th, 2020 may be removed and stored by the auctioneer at the purchaser’s expense. The auction site has NO DOCK LOADING available.
SHIPPING: - A palletizing service will be offered for an extra charge; all requests must be approved in advance on a case by case basis. Some equipment, due to its size, cannot be palletized on site.
